Terms and Conditions

By accessing or using CLIPcherry, you agree to these Terms. If you do not agree, do not use the platform.
1. Acceptance and Scope
These Terms govern your access to and use of the CLIPcherry websites, applications, APIs, and related services (the "Services"). These Terms apply to all users, including visitors, supporters, creators, and administrators.
Additional rules may apply to specific features (for example, credits, live streaming, or creator payouts). Where additional terms apply, they supplement these Terms.
2. Eligibility and Age Requirements
CLIPcherry is an adult platform. You must be at least 18 years old (or older where required by your jurisdiction) to access or use the Services.
You are responsible for complying with all laws that apply to you. If you access the Services from a location where use is restricted or prohibited, you do so at your own risk.
3. Accounts and Security
You are responsible for all activity under your account and for maintaining account security, including your credentials, connected wallets, devices, and sessions.
You must provide accurate information and keep it updated. You may not share, sell, or transfer your account without our written permission.
Notify us promptly through Support if you suspect unauthorized access.
4. Platform Role and User Responsibilities
CLIPcherry provides tools for creators to publish content and for supporters to preview, subscribe, unlock, tip, and message, subject to platform policies.
Creators are solely responsible for their content, pricing, claims, and legal compliance. Supporters are solely responsible for purchase decisions and wallet/payment accuracy.
5. Payments, Subscriptions, and Crypto Terms
Pricing is set by creators and/or platform settings. Before paying, you must confirm the destination details, amount, and any required network/tag fields.
Crypto transactions are generally irreversible. Except where required by law or explicitly stated by platform policy, payments, unlocks, tips, and credits purchases are non-refundable.
Subscriptions may renew until canceled. Cancelling prevents future charges and does not retroactively refund prior periods.
If we detect fraud, abuse, compliance risk, or technical error, we may delay, hold, reverse internal entitlements, or block transactions as needed for security and legal compliance.
6. Content, Rights, and Licenses
You retain rights to content you lawfully upload. By uploading content, you grant CLIPcherry a worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, and distribute that content as needed to operate and improve the Services.
You represent and warrant that you have all necessary rights, permissions, and legal authority for content you upload and for people depicted in that content.
You may not upload unlawful, infringing, non-consensual, deceptive, or exploitative content.
7. Prohibited Conduct
- Violating law, platform policy, or third-party rights.
- Attempting to bypass paywalls, access controls, moderation systems, or platform security.
- Posting malware, phishing content, deceptive links, or harmful code.
- Harassment, threats, doxxing, or other abusive behavior.
- Using automation or scraping that degrades service or violates policy.
- Impersonation, misrepresentation, or fraudulent payment activity.
8. Moderation, Suspension, and Termination
We may investigate reports, moderate content, restrict features, suspend accounts, remove content, or terminate access to protect users, platform integrity, or legal compliance.
We may take action with or without notice where risk requires immediate response. We may preserve logs and records for security, fraud prevention, and legal obligations.
9. Copyright and Intellectual Property
Platform branding, software, and design are owned by CLIPcherry or its licensors. You may not copy, reverse engineer, distribute, or exploit platform materials except as explicitly permitted.
If you believe content infringes your rights, submit a detailed notice through Support with sufficient information for review and response.
10. Disclaimers and Service Availability
The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, creator earnings, supporter outcomes, or compatibility with every device, wallet, or region.
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, CLIPcherry and its affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunities.
To the fullest extent permitted by law, CLIPcherry's aggregate liability for claims arising out of or relating to the Services will not exceed the greater of (a) amounts paid by you to CLIPcherry in the 12 months before the event giving rise to the claim, or (b) USD $100.
12. Indemnification
You agree to defend, indemnify, and hold harmless CLIPcherry, its affiliates, and their personnel from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your content, conduct, violations of these Terms, or violation of law or third-party rights.
13. Changes to the Terms
We may update these Terms from time to time. Updated Terms become effective when posted unless a later date is stated. Continued use after the effective date means you accept the updated Terms.
14. Governing Law and Disputes
These Terms are governed by applicable law in the jurisdiction designated by CLIPcherry at the time of dispute, without regard to conflict-of-law rules. You agree to bring disputes in the courts designated by CLIPcherry, unless mandatory law requires otherwise.
